PRIVACY AND SECURITY POLICY

Through this Privacy and Security Policy, we inform you about the aspects that you should know and authorize in relation to the privacy of your data in the APP.

CLAUSE ONE:  DEFINITIONS

1. APP: Application for mobile devices, which TRIP makes available to the USER.

2. FORCE MAJEURE: means the occurrence of an event or circumstance ("Force Majeure Event") that renders impossible or prevents a party from performing one or more of its contractual obligations under the contract, to the extent that the party affected by the impairment proves: (a) that such impairment is beyond its reasonable control; and (b) that the effects of the estoppel could not reasonably have been avoided or overcome by the affected party.

3. TRIP: is the PLATFORM operated by ISLAND TRAVELS, INC.

4. PERSONAL INFORMATION or PERSONAL DATA or USER DATA: "Personal Information" or "Personal Data" or "USER Data" is understood to be the USER's name, surname, email, telephone number, exact address, IP address, and any other personal information required by TRIP to the USER for the purposes of registering and receiving transportation services through the APP.

5. APPLICABLE LEGISLATION: It means, for each country in which TRIP operates or may operate in the future, the regulatory body that regulates everything related to data protection, as modified from time to time. For the Dominican Republic, the Organic Law on the Protection of Personal Data.

6. PLATFORM: The TRIP platform to which USERS may have access through the WEBSITE and the APP in order to request SERVICES offered by TRIP and its business partners.

7. POLICY: This Privacy and Security Policy.

8. SERVICES: All those SERVICES provided by TRIP through its WEBSITE or the APP, which consists of a private transportation request application that connects drivers and passengers. The app is designed to provide travelers with hassle-free transportation service.

9. WEBSITE: The website https://discover-trip.com.

10. USER: Any end consumer who registers on the TRIP PLATFORM, through the WEBSITE and the APP, as the final consumer of the transport service.

II. INFORMED CONSENT FOR STORAGE AND USE OF INFORMATION

II.1. Collection of information

By registering as a USER, or accessing our SERVICES, the USER freely and expressly consents to their PERSONAL INFORMATION being consulted, processed, processed and stored by TRIP.

Unless specifically stated otherwise, all the data that TRIP requests from you in the registration or application processes for SERVICES on the WEBSITE or in the APP are necessary to be able to register and provide the SERVICES. The USER is entitled not to provide their PERSONAL DATA; however, the USER acknowledges and accepts that this may imply that he/she will not have access to any or all of the SERVICES, due to the nature of these.

The USER must provide real, truthful, complete and updated information at the time of entering the information in the database linked to the WEBSITE and the APP. The USER acknowledges and accepts that the omission or inaccuracy in any of them could imply the impossibility of us providing the SERVICES and will empower TRIP to take actions such as deleting the USER's account, not providing the required SERVICES, or that the data provided by the USER be eliminated from the database.

CLAUSE TWO: 

1. Information You Provide to Us

We collect PERSONAL INFORMATION that the USER provides to us directly, for example, when you request or use our SERVICES, contact APP support staff or when you communicate in any other way (via WEBSITE, APP, telephone, mail and any other) with TRIP. This information may include: name, email, telephone number, postal address, profile picture, gender, marital status, date of birth, delivery notes, the content of the communication, metadata and other personal information that the USER provides.

1.1. Information We Collect Through Your Use of Our Services

When you use our Services, we collect PERSONAL INFORMATION in the following general categories:

• Location Information: When, how often, and under what circumstances you use our On-Demand SERVICES, we collect exact or approximate location data. The USER agrees that TRIP can access the location services through the permission system used by their mobile operating system, we may also collect the exact location of their device when the application is or is not in use, as long as the USER has activated this option on the WEBSITE and the APP. We may also obtain your approximate location from your IP address.

• Transaction Information: We collect data related to the use of our SERVICES, including the type of service requested, the date and time of provision of the SERVICE, distance traveled, travel time, and other details related to the transaction.

• Use and Preference Information: We collect information about how the USER interacts with our SERVICES, expressed preferences, and selected settings.

2. Use of Information

We may use the PERSONAL INFORMATION we collect about the USER for the following activities:

• Provide, activate, maintain, administer, and improve our SERVICES, such as facilitating payments, sending receipts or invoices (to which the USER's name will be associated), providing SERVICES requested by the USER (and sending related information or business communications), developing new features, providing USER support, developing security options, authenticating users, and sending administrative messages;

• Perform internal operations, such as keeping the WEBSITE and APP secure, prevent fraud and abuse of our SERVICES, troubleshoot software bugs and malfunctions, conduct data analysis, testing, and research, monitor and analyze usage and activity trends, verify compliance with the terms and conditions governing your use of our SERVICES (including monitoring private messages via the private courier service provided by TRIP);

• Send communications that have been requested or accepted under these terms by the USER or that may be of interest to you, including information about TRIP's SERVICES, promotions, news, and events, and where permitted and in accordance with APPLICABLE LAWS; and to process contests, sweepstakes, or other promotional entries and fulfill related prizes;

• The USER may authorize the PERSONAL INFORMATION to be shared with third parties, as indicated below, in accordance with the provisions of the Terms and Conditions of the WEBSITE and the APP. Such third parties will be required to meet the same security standards that TRIP  follows and that are required by APPLICABLE LAWS. We may share the information we collect about the USER with:

- Our customer service staff, to respond to questions and complaints from the App user in relation to the service provided;

- The public or in general if you submit the content to a public forum, for example, comments on blogs, social media messages or other options of our SERVICES available to the general public, in which case the USER acknowledges and agrees that he is responsible for this risk, for any improper, unauthorized or illegal use of the information by third parties;

- With third parties with whom TRIP has business relationships (but in such a way that these third parties will not be able to identify any individual USER with such information);

- With employees, officers, subsidiaries, affiliates, suppliers, consultants, agents, marketing partners, and other suppliers or contractors who reasonably need to access such information for the purposes described in this policy;

- In the event that PERSONAL INFORMATION must be disclosed by court order or by a competent authority with sufficient powers to require it from TRIP or to establish, exercise or defend TRIP's rights; or in the event that TRIP must report to the competent authorities any type of illegal activity by the USER in relation to the SERVICES.

• With any of the subsidiaries, affiliates or members of the same economic interest group, in the countries in which we operate, in such a way that the subsidiaries will not be able to identify a specific USER, which they reasonably need for the purposes described in this POLICY;

• With third parties by virtue of a possible negotiation or formalization of a merger, acquisition, financing, assignment or other similar transactions. In these cases, TRIP will only provide the information that is strictly necessary and in compliance with the legal guidelines established by the applicable legislation on the transfer of personal data.

For any other use not expressly described in this POLICY, which is previously notified and accepted by the USER.

USER DATA will not be assigned, communicated or transferred to third parties except as indicated in this POLICY.

The USER is aware of this POLICY with his/her acceptance, and expressly authorizes TRIP to carry out any operation or set of operations through automated or manual procedures in relation to his/her personal data. TRIP may collect, record, organize, store, modify, extract, consult, use, process, transmit, transfer, collate, block, delete or destroy the USER's PERSONAL INFORMATION.

The USER understands and accepts that automated data processing procedures include any operation, set of operations or procedures that TRIP applies or may apply to PERSONAL INFORMATION, through the use of software, bots, artificial intelligence, networks, applications, in physical or virtual sites, or any other technology that allows the collection, the recording, access, organization, storage, modification, retrieval, consultation, use, communication by transmission, transfer, comparison, networking, blocking, deletion, destruction, exchange or digitization of personal data.

The transfer of data carried out in accordance with this informed consent will be carried out under security standards that guarantee the USER and TRIP that the information will be processed, processed and stored in accordance with the specific purposes of this informed consent.

The information and data collected by TRIP will be treated with absolute privacy, confidentiality and security, as stipulated by current and applicable legislation on the matter.

The USER, with the reading and express acceptance of this POLICY, in an informed, individualized, clear, precise, unequivocal, voluntary, free manner, and aware of the scope of what is accepted herein, grants their informed consent for the processing of their data as indicated herein.

The USER may access the information in their account at any time, as well as request access, update, modification and deletion of the information contained therein, free of charge. If you would like to deactivate your account, please email us at support@mdctrinc.com or via online chat available in the "Contact Us" section of the TRIP web portal. Please note that in some cases we may retain certain information about you as required by law or for legitimate business purposes to the extent permitted by APPLICABLE LAWS for a period not exceeding 10 years. For example, if you have an outstanding credit or debt on your account, or if we believe you have committed fraud or breached our Terms and Conditions, or if there are any current or prospective legal proceedings. But in any of these cases you will be duly informed. The USER understands and accepts that he/she is solely responsible for keeping his/her database up to date.

By accepting our Privacy Policy and providing the required USER INFORMATION, it will be understood that the USER issues formal Informed Consent for the processing of their data as established in this POLICY. In this sense, the USER acknowledges that: he/she has read, understood and accepts the scope of this POLICY; that you have no doubts related to the form, means and purpose for which the PERSONAL INFORMATION has been requested; expressly and voluntarily accepts your registration in our Database, authorizes the processing of the PERSONAL INFORMATION granted, and acknowledges that you have been informed of the means by which you may unsubscribe from our Database and control the information you provide to TRIP.

CLAUSE THREE: COMMUNICATION WITH THE USER

Any REGISTERED USER who uses the SERVICES, or who writes to us by email, may receive communications by any of these means or platforms from TRIP. The USER agrees that TRIP may communicate by any means registered by the USER: information about promotions, invitations to events, notifications about changes to this POLICY, and the TRIP Terms and Conditions, as well as any other information or formal notification that TRIP needs to communicate to the USER.

All electronic communications sent by TRIP shall duly disclose the name of the sender and the manner in which he or she may object to further receipt of communications.

The USER will have the option of accepting or not the receipt of emails by TRIP. However, you may, at any time, request to stop sending emails to your email account, by clicking on the "unsubscribe" option that appears at the bottom of each email, or by means of online chat available in the "Contact Us" section of the TRIP website. However, this may be a reason to cancel the SERVICES to the USER, since, for the correct use of the APP, it is essential for TRIP to be able to communicate with the USER via email.

CLAUSE FOUR: USE OF COOKIES AND OTHER SYSTEMS AND TECHNOLOGIES

When the USER visits our WEBSITE and our APP, some of the browsing data is sent from their computer or mobile device to our servers. This information allows us to optimize our SERVICES, personalize and improve your experience on our WEBSITE or the APP. This information may include:

- Your IP address

- The date and time of your visit

- The referring URL

- The pages you visited on our WEBSITE.

- The functions you used within the APP.

- Information about the browser you used.

- Time spent on the WEBSITE and the APP.

- Number of times you access the WEBSITE and the APP and the times you visit any page of the WEBSITE or use any of the functions available in the App.

TRIP uses various technologies to collect information when the USER visits our WEBSITE and our APP and this may include sending one or more cookies or other identifiers to your device. The systems and technologies we use are as follows:

1. Cookies

A cookie is a small text file that is stored in your browser when you visit almost any website. Its usefulness is that the website is able to remember your visit when you browse that page again.

Cookies usually store information of a technical nature, personal preferences, content personalisation, usage statistics, links to social networks and access to USER accounts. The objective of the cookie is to adapt the content of the website to your profile and needs, without cookies the services offered by any page would be significantly reduced.

Our cookies are used to analyse how you interact with our WEBSITE and APP, in order to optimise our SERVICES and to improve your experience. Due to the way in which the WEBSITE and the APP work, if the USER deactivates or blocks the use of this system, errors may be caused in the operation or use of the WEBSITE and the APP.

2. Web beacons or Web Beacon

A "web beacon" is an image file used to track the USER's navigation through the Website. Web beacons, also called "web bugs" are mainly used to monitor the USER's navigation through the WEBSITE and the APP. Due to the way in which the Website works, if the USER deactivates or blocks the use of this system, errors may be caused in the operation or use of the WEBSITE and the APP.

3. Web server logs

A web server log is a simple text file that records activity on a server. This type of system allows statistics to be obtained on the browsing patterns of Users. Due to the way in which the Website and the App work, if the USER deactivates or blocks the use of this system, errors may be caused in the operation or use of the WEBSITE and the APP.

4. Geolocation Technology

Geolocation technology allows the determination of the USER's location by means of geographical coordinates (latitude and longitude) on a common map. The information will be obtained by identifying the IP of a device connected to the Internet, by means of a network provider, by means of a device with a GSM network or by means of a GPS, so that the terms and conditions of the third-party provider will be applicable to such geolocation services. Due to the way in which the WEBSITE and the APP work, if the USER deactivates or blocks the use of this system, errors may be caused in the operation or use of the WEBSITE and the APP.

To prevent their device from allowing the use of the aforementioned technologies, the USER must reject the request for authorisation that will be displayed on the screen of their device, prior to browsing certain sections of our WEBSITE and the APP.

If the USER has any questions about the aforementioned technologies, how they work, how to disable them or any other type of concern in relation to those used on our WEBSITE and the APP, they should contact us by the means available in the "Contact Us" section of the TRIP website.

5. DATA AND TRANSACTION SECURITY ASPECTS

We are committed to protecting your PERSONAL INFORMATION and have taken appropriate technical and organizational measures to protect such information from loss, alteration, access, or misuse.

TRIP informs you that your Personal Data is stored in a database owned by it, and you are guaranteed the appropriate technical and structural measures to guarantee the integrity and security of the PERSONAL INFORMATION provided in accordance with its current status.

TRIP maintains the security levels of protection of your data in accordance with the applicable legislation, relating to the security measures of the databases containing personal data and has established all reasonable technical means, at its disposal, to prevent the loss, misuse, alteration, unauthorized access and theft of the data that the USER communicates to TRIP, without prejudice to informing you that Internet security measures are not infallible.

6I. LIABILITY BURDENS

The USER acknowledges and accepts that the use of the WEBSITE and the APP is carried out at all times at their own risk and responsibility, as well as for the improper use that may be made of these means of communication or technologies.

The USER acknowledges and accepts that he/she is solely responsible for damages of any kind caused to the USER's electronic equipment (computer, telephone, tablet, or others) by viruses, worms or any other harmful element. The USER acknowledges that the use of the Internet network implies the assumption of a risk that their computer equipment may be affected by the elements listed above. To this end, it is the responsibility of the USER, in any case, to have adequate tools for the detection and elimination of harmful electronic programs that may pose a risk to their computer equipment.

The USER acknowledges and accepts that he/she is solely responsible for the failure to perform his/her obligations when there is force majeure, fortuitous event or the entry into force of governmental legislation, regulations or restrictions of any other nature that prevent the execution of his/her obligations.

7. CHANGES TO THE PRIVACY POLICY

TRIP will notify the USER by any of the means of contact indicated by the USER, prior to its entry into force, who in turn must accept any change or adjustment to this Privacy Policy.
